1. About these terms
These Terms of Use ("Terms") govern your use of the HR Health Check platform ("the Platform") operated by Lab8 Digital Ltd, a company registered in England and Wales (company number 17078500) with its registered office at Unit 3 Icon, Eastern Way, Daventry, England, NN11 0QB ("we", "us", "our").
By accessing or using the Platform you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Platform. These Terms should be read alongside our Privacy Policy, which explains how we collect, use, and protect your personal data.
2. What the Platform does
HR Health Check is a platform for HR consultancies ("Partners") that enables their clients to complete HR compliance assessments. Partners subscribe to the Platform and provide their clients with access to branded assessments. Based on the answers provided, the Platform generates a scored report with a risk rating, category breakdown, identified issues, and a suggested action plan.
These Terms apply to both Partners who subscribe to the Platform and the clients who complete assessments through it.
3. Eligibility
The Platform is designed for UK HR consultancies and their clients. By using the Platform, you confirm that:
- you are at least 18 years old;
- you are authorised to act on behalf of the organisation for which you are completing the assessment; and
- the information you provide is accurate and complete to the best of your knowledge.
4. Not professional advice
The Platform provides general guidance only. It does not constitute legal, regulatory, or professional HR advice.
Results are indicative and based solely on the answers you provide. UK employment law is complex and subject to frequent change. The Platform may not reflect the most recent legislative developments, and its output may not account for the specific circumstances of your business.
You should always seek qualified professional advice before making decisions that affect your organisation's HR compliance, employment contracts, or people management practices. We strongly recommend consulting a qualified HR professional or employment lawyer for advice specific to your situation.
5. How we use your data
When you use the Platform, we collect the personal and business information you provide (such as your name, email address, phone number, company name, and assessment responses). Full details of how we process this data, the lawful bases we rely on, and your rights are set out in our Privacy Policy.
By using the Platform you acknowledge that we may use the contact details you provide to:
- deliver your assessment results and report by email;
- follow up regarding your assessment results and how we may be able to help; and
- where you have given separate consent, send you marketing communications about our HR consultancy services.
You can opt out of marketing communications at any time using the unsubscribe link in any email, or by contacting us at contact@hrhealthcheck.co.uk.
6. Your obligations
You agree not to:
- provide false, misleading, or incomplete information;
- use the Platform for any purpose other than its intended use;
- attempt to access, interfere with, or disrupt the Platform's systems, security, or other users' data;
- scrape, copy, or extract data from the Platform by automated means;
- reverse-engineer, decompile, or attempt to derive the source code, scoring methodology, or algorithms of the Platform; or
- use the Platform to develop a competing product or service.
7. Intellectual property
All intellectual property rights in the Platform — including its design, content, questions, scoring methodology, algorithms, reports, branding, and underlying software — are owned by us or our licensors and are protected by copyright, database rights, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose and to view and download your own assessment report for internal business use. You may not reproduce, redistribute, modify, or create derivative works from any part of the Platform or its outputs without our prior written consent.
8. Limitation of liability
To the fullest extent permitted by law:
- the Platform is provided "as is" and "as available" without any warranties, express or implied, including as to accuracy, completeness, fitness for a particular purpose, or non-infringement;
- we do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components;
- we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill, arising from your use of (or inability to use) the Platform;
- we shall not be liable for any decisions made, actions taken, or actions not taken based on the assessment results or any content provided by the Platform; and
- our maximum aggregate liability to you in connection with the Platform shall not exceed one hundred pounds sterling (GBP 100).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
9. Availability and changes
We may update, modify, suspend, or discontinue the Platform (or any part of it) at any time without notice. We reserve the right to amend these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Platform after any change constitutes acceptance of the revised Terms.
10. Termination
We may restrict or terminate your access to the Platform at any time, for any reason, without notice. Upon termination, the provisions of these Terms that by their nature should survive (including sections on intellectual property, limitation of liability, and governing law) shall continue to apply.
11. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Platform and supersede all prior agreements and understandings.
